Terms of use.

Agreement

These terms apply to smellthesmoke.com and to everything you buy through it. Using the site or placing an order means you accept them. If you do not, please do not use the site. The site is operated by STS Media, STS Media, 1427 East 36th Street, Suite 4203B, Cleveland, Ohio 44114.

What we provide

Design, web development and print management. Printing and finishing are carried out by production partners; we specify the job, review the artwork, manage the run and stand behind the result. Your point of contact is STS Media throughout.

Quotes and orders

Prices on product pages are current and include the options shown. Custom project work is quoted in writing before it starts, and a quote is valid for 30 days unless it says otherwise.

An order is accepted when we confirm it. We may decline or cancel an order — with a full refund — if a price or description is wrong, if artwork cannot be produced to a usable standard, or if the content is unlawful.

Payment

Store orders are paid in full at checkout. We accept major credit cards, PayPal, Square and Cash App at checkout, and ACH bank transfer for project work.

Project work requires a 50% deposit to begin, with the balance due on delivery of final files. Retainers are billed monthly on the same date each cycle. Final files and production releases are delivered once payment clears.

Artwork, proofs and approval

You are responsible for the accuracy of what you approve — spelling, numbers, dates, phone numbers, prices, bleed and trim. Approval authorises production, and once a job is approved and released it cannot be changed or cancelled.

Every order gets a free artwork review before anything runs, and we will flag files that will not hold up at size. That review is a courtesy check, not a proofread of your copy.

Printed colour varies from what a screen shows, and can vary slightly between runs, stocks and coatings. Variation within normal commercial tolerance is not a defect.

Turnaround

Quoted turnaround is production time in business days and starts after artwork approval, not at checkout. Shipping is additional — see the Shipping Policy. Turnaround is an estimate made in good faith, not a guaranteed delivery date.

Your content

You keep ownership of what you supply, and by supplying it you confirm you have the right to use and reproduce it. You agree to indemnify STS Media against claims arising from artwork or content you provided — including copyright, trademark and right-of-publicity claims.

We will not knowingly produce material that is unlawful, infringing, or that we reasonably judge to be hateful or deceptive.

Our work

On final payment you receive the agreed deliverables and the right to use them for the purpose described in the brief. Working files, unused concepts and source materials remain ours unless the quote says otherwise. We may show completed work in our portfolio unless you ask us in writing not to.

Website service tickets

A $45 service ticket buys one prepaid hour of labor on one website. Initial response is 48–72 business hours — a response window, not a completion window.

• Unused time is not banked or refunded.
• Work beyond the prepaid hour needs your approval and further payment.
• Each website needs its own ticket.
• It is not a retainer, not 24/7 cover, and not an emergency service.

Consultations

A paid consultation is a scheduled 45-minute call — advice and direction, not implementation. Reschedule or cancel free up to 24 hours before the start time. Inside 24 hours, or if you do not attend, the fee is not refunded.

Disclaimer

The site and its content are provided “as is”. We do not warrant that the site will be uninterrupted or error free. Nothing here excludes liability that cannot lawfully be excluded.

Limitation of liability

To the fullest extent Ohio law allows, STS Media’s total liability for any claim arising from an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including lost profits, lost business or missed events.

Governing law

These terms are governed by the laws of the State of Ohio, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Cuyahoga County, Ohio, and both parties submit to their jurisdiction.

Changes

We may update these terms. The version in force is the one published here on the date of your order, and the date at the top of this page tells you when it last changed.
